XAER_RMERR and JBOSS crash

We are having a JBOSS crash after a mismanaged transaction to a different server and we think that our system couldn't cope up with it thus we are receiving the following error and made the JBOSS crash.

WARN [org.jboss.tm.TransactionImpl] XAException: tx=TransactionImpl:XidImpl[FormatId=257, GlobalId=EMEAU1801/835, BranchQual=, localId=835] errorCode=XAER_RMERR
javax.transaction.xa.XAException: [Microsoft][SQLServer 2000 Driver for JDBC][SQLServer]xa_start (40000) returns -8

I just want to ask if the fix for JBAS-3336 can be applied to our JBOSS version too or if our issue is related to JBAS-3336?

JBOSS version: 4.0.2
JDK version: 1.4.2_08
