<%=request.getContextPath()%> not procesed when used in rich:jQuery query

Im trying to us <%=request.getContextPath()%> inside the query for rich:jQuery without success, the directive does not get processed, it is just sent to the browser as is. can any one point out where im going wrong.

<rich:jQuery name="checkFolder" timing="onJScall" query="do somthing that needs <%=request.getContextPath()%>"/>
