fields within rich:modalPanel not binding to backing bean

I have a modal panel on the screen with several h:inputText items bound to a backing bean. Alson on the panel is a a4j:commandButton with the folowing functionality:

1) invoke action on bean
2) rerender portions of the main page (not inside the dialogue)
3) close the dialogue (oncomplete)

For some reason the fields are not being set on the bean prior to the action being invoked (actually not being set at all). If I encapsulate the fields inside of a DIV or a4j:outputPanel - everything works as expected.

In the process of putting together the sample code (snipped together from various facelets) I noticed that indeed I did have a form in my modal panel, BUT it wasn't an h:form (too quick to think, too slow to type).
