the first rule means:<rich:modalPanel...> <f:form> ... </f:form> </rich:modalPanel>
and the second one means generally do NEVER something like:<h:form> ... <h:form> ... </h:form> ... </h:form>
Summarizing that you get the following rule for your case:
"To work properly the <rich:modalPanel> should always be placed outside the original <h:form> and must include its own <h:form> for such cases like performing submissions from within the <rich:modalPanel>. " (Dev Guide, 6.69.5) -

No.
To take your example, do it this way:<f:view> <h:form> ... </h:form> <rich:modalPanel...> <h:form> ... </h:form> </rich:modalPanel> </f:view>
In my opinion, the dev guide says nothing else. I hope it is, finally, clear enough now. -
