orphan java process

Below issue is resolved in which JBOSS version?  Please let me know which free version reolved this or still it is an issue.
If yes , what is a defect tracking number ? We are using JBOSS 4.0.2.

The issue is actually with running the jboss  4.0.2   for longer period.
Once we start the jboss it spawns a java.exe process with root privileges on a Machine .
However, over time this java process runs out of the heap memory. Due to this jboss leaves this java process orphan and spawns the new one. This way if jboss is kept running for longer time,it might spawn more than 100 java processes.

This issue is occurs on Windows server 2003 when jboss is running as a windows service.

It says outofmemory error because of reasons specifed in above link. Is this is the same issue ?
